Terms and conditions

Sign up to Nectr’s Battery AddOn plan between 1 December 2021 and 28 February 2022 to score a sizzling $1,200 discount on the solar battery costs over the duration of the contract*.

Terms & Conditions

  1. This offer is made by Nectr Distributed Energy Pty Ltd ABN 48 638 767 272 (Nectr DE). References below to Nectr are references to Nectr DE and/or (as applicable) Hanwha Energy Retail Australia Pty Ltd ABN 82 630 397 214 trading as Nectr, both of Level 25, Northpoint Tower, 100 Miller Street, North Sydney NSW 2060.
  2. This offer (the Offer) is available from 12.01am (AEDT) on 1 December 2021 to 11.59pm (AEDT) on 28 February 2022 (the Offer Period).
  3. If you are an eligible customer who joins and participates in Nectr’s Battery AddOn plan, including entering a “New Energy Finance” agreement with Nectr during the Offer Period, you will be eligible to receive $1,200 credit on the battery hardware component of the plan.
  4. Both existing Nectr electricity customers and new customers may participate in the Offer if they meet the eligibility requirements.
  5. The Offer is open to customers:
    • who are residential customers aged 18 or over;
    • who own the residence where the battery system will be installed and maintain that residence as their primary place of residence;
    • who meet Nectr’s credit assessment criteria;
    • who are eligible to join and participate in Nectr’s Battery AddOn plan; and
    • whose residence is located within one of the following energy distribution networks:
      • the Ausgrid network area;
      • the Endeavour Energy network area; or
      • the Energex network area.
  1. If at any time a customer participating in the Offer ceases to meet any of the eligibility criteria in these terms and conditions, that customer’s right to the benefits of the Offer will cease.
  2. The $1,200 discount will be applied as a $20 per month discount against only the battery system repayment component of a participating customer’s monthly Nectr bills for the 60 months of the Battery AddOn plan duration. The discount will not be applied against any energy fees or associated charges.
  3. Each customer may receive the Offer for a maximum of five (5) eligible premises.
  4. The $1,200 discount is not transferable, exchangeable or redeemable for cash.
  5. If a participating customer exits their “New Energy Finance” agreement with Nectr earlier than the 60 month term of that agreement, or ceases to be eligible for the Offer before the term of that agreement is completed, the customer will retain the benefit of monthly discounts received to that time under the Offer but will not receive any further discount (so they will not receive the full $1,200 discount).
  6. The Offer will apply in addition to any other bill credits offered by Nectr including:
    • a $10 monthly credit towards electricity charges that may be available to customers participating in Nectr’s Virtual Power Plant (VPP) program; and
    • a $200 bill credit that may be available to customers participating in Nectr’s New Energy Referral Program
  1. Nothing in these terms and conditions restricts, excludes or modifies any consumer rights that consumers may have under any statute including the Competition and Consumer Act 2010 (Cth).
  2. Except for any conditions, warranties and representations expressly stated in these terms and conditions, to the extent permitted by law Nectr excludes all conditions, warranties and representations under or in connection with the Offer and these terms and conditions.
  3. To the extent permitted by law, Nectr’s liability for breach of any condition, warranty or guarantee imposed by statute that cannot be excluded and a customer’s sole and exclusive remedy in relation to such breach will be limited to (at Nectr’s election):
    • supplying the relevant services again; or
    • paying the cost of having the services supplied again.
  1. Nectr’s total aggregate liability to a person in respect of any claim, loss, damage, expense or liability arising under or in connection with the Offer or these terms and conditions (including in negligence) will not exceed $1,200.
  2. Nectr’s liability to a person under or in connection with the Offer or these terms and conditions (including in negligence), except for any liability Nectr has to that person in relation to any discount properly earned by them under these terms and conditions, will be reduced by the extent, if any, to which that person contributed to that liability.
  3. Nectr will use your personal information to conduct and manage the Offer, to provide energy to you and manage its relationship with you and as otherwise permitted by law. Nectr may disclose your personal information to its related companies, agents and contractors to assist in these purposes. This may include disclosures of your personal information to organisations outside Australia including in places such as the United Kingdom, the United States of America, Canada, South Korea, Hong Kong and the Philippines.
  4. By participating, you consent to receive email or SMS messages from Nectr in relation to the Offer without any functional unsubscribe facility.
  5. Nectr may use your personal information to tell you about products or services that Nectr thinks you might be interested in where you have consented to Nectr doing so, or it is otherwise permitted by law. Nectr will seek to comply with all relevant privacy legislation in relation to your personal information. You can find Nectr’s Privacy and Credit Reporting Policy on Nectr’s website. If you have any questions, you can contact Nectr’s privacy officer. Nectr’s Privacy and Credit Reporting Policy contains information about:
    • how to seek access to the personal information Nectr holds about you and seek correction of the information; and
    • how to complain about a privacy breach and how Nectr will deal with such a complaint.
  1. This offer is in no way sponsored, endorsed or administered by, or associated with, any social media platform including Facebook, Instagram and Twitter. Customers and prospective customers provide their information to Nectr and not to any social media platform. Customers and prospective customers completely release any relevant social media platforms from any and all liability.
  2. Customers may be required to execute documentation with Nectr to confirm and formalise their participation in the Offer.
  3. Nectr may, at any time, require a person to produce documentation to establish to Nectr’s satisfaction their eligibility to participate in the Offer (for example, documentation establishing their identity, age, place of residence and ownership of residence). Failure by Nectr to enforce any of its rights at any stage does not waive those rights.
  4. Nectr may exclude or suspend a person from the Offer or from receiving benefits under the Offer if the person
    • breaches these terms and conditions
    • engages in any conduct that may jeopardise the fair and proper conduct of the Offer;
    • acts in a disruptive, annoying, threatening, abusive or harassing manner;
    • does anything that may diminish the good name or reputation of Nectr or any of its related entities or contractors;
    • breaches any law in connection with the Offer or their participation in the Offer; or
    • behaves in a way that is otherwise inappropriate
  1. Nectr is not liable if the Offer cannot run as planned for any reason beyond Nectr’s control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure.
  2. Nectr may amend these terms and conditions from time to time, provided that the amendments do not cause unreasonable financial or other detriment to customers or prospective customers. The amended terms and conditions will apply from the time they are posted on the Nectr website or otherwise notified to the relevant persons.
  3. Nectr may terminate the Offer by notifying customers and other persons on the Nectr website or otherwise, provided that Nectr provides sufficient notice so that the termination does not cause unreasonable financial or other detriment to customers or prospective customers.
  4. These terms and conditions are governed by the laws of New South Wales.
